What is a peptide?

Peptide is a short chain of amino acids, which FDA defines as 40 or fewer. Longer chains are proteins. Peptides sit between small-molecule drugs and large proteins, and many approved medications are peptides. Because a peptide is not a biological product, it is regulated as a drug and must be FDA-approved before it can be marketed.

How does FDA define a peptide?

By length. FDA treats any amino-acid polymer of 40 or fewer amino acids as a peptide, and any chain longer than 40 as a protein [1]. That line matters legally: a protein is a biological product, while a peptide is not, so a peptide is regulated as a drug under the Federal Food, Drug, and Cosmetic Act [1][2]. A new peptide drug must be approved under section 505 before it can be marketed, like any other drug [2].

What is the difference between approved and unapproved peptides?

Approved peptide drugs have been through FDA review of both safety and effectiveness. A 2026 review in Sports Medicine describes a parallel "gray market" of unapproved peptides sold direct to patients, operating largely outside regulatory oversight [3]. Many of these show tissue-repair or metabolic effects in animal models, but rigorous human safety data are scarce and the authors warn of potential for serious harm [3]. Examples on that unapproved list include BPC-157 and TB-500 [3].

Is peptide therapy legal?

It depends on the peptide and how it reaches you. An FDA-approved peptide prescribed by a licensed clinician is a normal prescription. A compounded peptide is legal only within the compounding rules, and products sold as research use only are not lawful drugs for human use.
